Nitric Acid & Ammonium Nitrate Production Plant

Process Plant

CPMI evaluated delays and disruption experienced by a contractor during a $90 million expansion of an ammonium nitrate facility. This time-and-materials contract involved reconstructing plants relocated from an existing facility. The project incurred significant cost overruns from late and deficient engineering, numerous changes, and the existing condition of equipment. Our team evaluated delays associated with late engineering and changes, and the impact on labor efficiency and budget increases. CPMI prepared an expert report on cost increases and impacts on productivity, and testified at the trial. The dispute resulted in a favorable decision for the contractor.

Pacific Island Roadway Project

As the selected experts analyzing cost and fraud issues on this project, we worked closely with CPMI during discovery, pretrial preparation, and the 13-week trial. Pacific Island Roadway Project

CPMI evaluated delay and inefficiency claims on the construction of 53 miles of 24-foot-wide asphalt roadway in a small Pacific island republic. Issues included high rainfall in the tropical climate, soil compaction, and resulting delays and impacts. Our team prepared a CPM schedule analysis, developed an as-built schedule and evaluated contractor's lost productivity claim. CPMI also prepared an expert report, presenting detailed delay analysis, and an analysis of inefficiency costs. In addition, two CPMI representatives presented expert testimony at trial in the Court of Federal Claims, where our client received a favorable award.

NFL Football Stadium

CPMI was retained by the electrical subcontractor to quantify the subcontractor's loss of productivity damages related to numerous disruptive issues encountered during the construction of this $360 million facility. Our team prepared an expert report, setting forth opinions as to the cause and amount of damages sustained. The dispute was presented to an arbitration panel and resulted in a favorable settlement.

This project consisted of two 103 MW gas-fired combustion turbine generators, two heat recovery steam generators and two steam turbine generators.

Cogeneration Power Plant

CPMI provided claims analysis services on behalf of a design-build joint venture in connection with an engineer-procure-construct contract for a 286 MW combined-cycle cogeneration plant. The engineering, procurement, construction, start-up and testing of the facility was completed on a fast-track turnkey basis. CPMI organized the project documents, analyzed technical issues and prepared a delay analysis of the key issues that delayed turnover. CPMI also assisted counsel in preparing for mediation.

High School of the Future

New learning space …

This 162,211-square-foot high school incorporated the latest technologies to support and enhance academics and administrative functions for approximately 750 students.

Secondary School

CPMI provided scheduling support for the general contractor in a multi-prime contract, which included coordinating schedules from eight prime contractors, cost and resource loading, monthly schedule updates, on-site construction support, and time extension requests. Early in the construction, change orders to structural steel impacted the work by five months. CPMI worked with the project team to accelerate the schedule and present options for opening on time to meet the school district's requirement.

Defense Contract

CPMI provided expert witness services to the U.S. Department of Justice and the Air Force for the analysis of a $547 million claim. The claim, brought by a defense contractor, arose from $453 million in contracts for the full-scale development and production of a military gunship. The contractor claimed damages under numerous legal theories, including improper contract type, superior knowledge, mutual mistake, defective and late government-furnished property (GFP), defective specifications, constructive changes, and breach of contract. CPMI's scope of work included document organization and development of issue files; analysis of technical issues; development of a detailed schedule analysis to quantify and determine the causes of critical program delays; and discovery support. CPMI supported the government throughout an extensive negotiation process that resulted in settlement of the case.

Miami International Airport, South Terminal

Facilitating progress …

CPMI provided expertise on behalf of the airport authority in defense of a claim regarding the addition of a $900 million, 1.6-million-square-foot project.

International Airport

The South Terminal Development Project involved renovation and new construction at a major Florida airport. CPMI was engaged by the Owner to provide contract dispute analysis and resolution services on a delay and disruption claim. The project encountered a number of critical delays that severely impacted construction progress. CPMI examined issues regarding a complex, state-of-the-art electronic security system and devices; numerous design changes and extra work performed while the airport remained in use; extra work as a result of changing code implications and jurisdiction; and changes associated with the smoke evacuation system. CPMI conducted a critical path delay analysis, identified the causes of delay and the responsible party, and attended numerous change-order negotiations. The case was settled prior to litigation. CPMI also evaluated active schedules on the project to ensure completion.

Metropolitan Detention Center

Over a million pages ...

In an abbreviated discovery period, and complicated by a change in attorneys, CPMI assisted with the collection and analysis of over one million pages, and provided technical input to the DOJ in dozens of depositions.

During construction of a $100 million, 14-story prison, CPMI provided consulting services to the Federal Bureau of Prisons. In addition to pre-termination assessment of construction status and an evaluation of the revised schedule, CPMI was hired by the U.S. Department of Justice (DOJ) to provide delay analysis, issue studies and discovery assistance. CPMI authored an expert report, which included studies of key technical issues (i.e., analysis of the design, manufacturing and installation of metal cell panels, security windows, precast panels, security electronics, concrete defects, and chillers) and a detailed CPM schedule analysis of the impact of technical issues and changes on the project. CPMI provided expert testimony at trial. The Court of Federal Claims upheld the default termination.

Pacific Island Roadway Project

CPMI truly showed its colors when it handled this assignment. Litigation had started on several fronts—even before the construction was completed—so it was necessary for CPMI to simultaneously engage in real-time scheduling and forensic analysis. They handled this extremely complicated effort with aplomb.

Historic Building Renovation

CPMI provided scheduling services and claims analysis for this historic building renovation. The $25-plus million renovation converted a former manufacturing facility into a large state-of-the-art office space. The CPMI team prepared a recovery schedule on short notice, incorporating input from the contractor; monitored progress; and updated the schedule weekly. CPMI reviewed documentation of changes and delays, prepared a time impact analysis evaluating delays through project completion, and assisted in the resolution of schedule and delay issues.

Miami International Airport, South Terminal

The task assigned to CPMI was difficult. They had to construct an as-built schedule, analyze and apportion responsibility for delay, and evaluate the merits of substantive change orders. They did that in a comprehensive report and provided authoritative testimony at arbitration hearings that proved key to a successful result for the client. They communicated effectively with us throughout the matter. We found their billing to be fair. All in all, they were a pleasure to work with.

Higher Education Facility

CPMI assisted in defending a contractor's claim arising from the underground steam piping installation at a New Jersey university. The project was completed eight months late and the contractor alleged differing site conditions. CPMI prepared an expert report on delay issues and an extensive analysis of the 44 change order requests submitted by the contractor. CPMI testified at the arbitration proceedings. The arbitrator accepted CPMI's analysis as reasonable and cogent. The contractor unsuccessfully appealed the findings.
